E-Bike Horizon Liability Waiver

By renting, operating, or riding an electric bicycle provided by E-Bike Horizon, the rider acknowledges and agrees to the following terms and conditions:

Assumption of Risk

I understand that riding an electric bicycle involves inherent risks, including but not limited to:

  • Loss of control
  • Falls and collisions
  • Road hazards and surface conditions
  • Mechanical failure
  • Weather conditions
  • Actions of other riders, pedestrians, or vehicles
  • Personal injury, property damage, or death

I voluntarily choose to participate in this activity and fully accept all risks associated with operating an electric bicycle.

Rider Responsibility

I agree to operate the rented bicycle in a safe and responsible manner and to comply with all applicable local, state, and federal laws.

I understand and agree that I am responsible for:

  • Operating the bicycle safely at all times
  • Following all traffic laws and regulations
  • Using appropriate caution around pedestrians and vehicles
  • Wearing a helmet during operation
  • Ensuring the bicycle is returned in the same condition in which it was received, excluding normal wear and tear

Rider Eligibility

By signing this waiver, I confirm that:

  • I am at least 18 years of age, or I am riding under the supervision and responsibility of a legal guardian.
  • I possess the physical ability to safely operate an electric bicycle.
  • I am not under the influence of alcohol, drugs, or any substance that may impair my ability to ride safely.

Restricted Riding Areas

For safety and insurance purposes, riders agree that E-Bike Horizon bicycles may not be operated:

  • On beaches or sandy areas.
  • Across the St. Simons Island causeway.
  • On private property without permission.
  • In areas where bicycle access is prohibited by law.

Failure to comply with these restrictions may result in additional charges or immediate termination of the rental agreement.

Damage, Loss, and Theft

The renter accepts financial responsibility for any damage, loss, theft, or destruction of the rented bicycle or accessories occurring during the rental period, except where prohibited by law.

This includes, but is not limited to:

  • Damage caused by misuse or negligence
  • Lost accessories or equipment
  • Theft resulting from failure to properly secure the bicycle

Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless E-Bike Horizon, its owners, employees, contractors, affiliates, and representatives from any and all claims, liabilities, demands, actions, damages, costs, or expenses arising out of or related to my participation in bicycle rental activities.

This release includes claims resulting from personal injury, property damage, loss, or death, whether caused by negligence or otherwise, except where prohibited by applicable law.

Medical Authorization

In the event of an emergency, I authorize emergency medical treatment if I am unable to provide consent myself. I understand that I am solely responsible for any medical expenses incurred.

Acknowledgment

By accepting this waiver, I acknowledge that:

  • I have carefully read and fully understand this Liability Waiver.
  • I understand that I am giving up certain legal rights.
  • I agree to all terms and conditions stated above.
  • I voluntarily agree to participate in the rental activity and assume all associated risks.
